Terms of Use for BJMP

1. Account Creation and Registration
Eligibility: BJMP users, including officers, administrators, and any authorized personnel, must create an account to access and use the platform. The information provided during registration must be accurate, complete, and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Restricted Access: Access to specific data or functionalities within the platform may be restricted based on your role within the BJMP. Unauthorized access to areas beyond your granted permissions is prohibited and may result in the suspension or termination of your account.

2. Data Handling and Privacy
Sensitive Information: BJMP is responsible for handling sensitive information related to Persons Deprived of Liberty (PDL). All users must adhere to the strictest standards of data protection and confidentiality as outlined in the Privacy Notice and applicable laws. Any unauthorized disclosure, misuse, or breach of this information will result in disciplinary action, including possible legal consequences.
Data Accuracy: It is the responsibility of BJMP personnel to ensure that all data entered into the platform is accurate and up-to-date. Inaccuracies or omissions can affect the welfare and legal standing of PDLs and must be avoided.

3. Information Sharing and Communication
Inter-agency Collaboration: When necessary, BJMP may share information with other government agencies or authorized entities to facilitate legal processes, rehabilitation programs, or other official duties. All information sharing must be conducted in compliance with applicable data protection laws and BJMP policies.
Internal Communication: Communication within the platform should be conducted professionally and strictly for official purposes. Any misuse of the communication tools, including sending inappropriate or irrelevant messages, is prohibited.

4. System Use and Compliance
Platform Integrity: Users are prohibited from engaging in activities that could compromise the integrity, security, or functionality of the platform. This includes, but is not limited to, introducing viruses, hacking, or attempting to gain unauthorized access to restricted areas of the platform.
Compliance with BJMP Policies: All actions performed on the platform must comply with BJMP’s internal policies, as well as local laws and regulations. Failure to adhere to these requirements may result in disciplinary measures, including suspension or termination of access to the platform.

5. Intellectual Property
Platform Content: All content, materials, and data accessible through the platform are the property of PCES Inc. and/or its licensors, unless otherwise stated. BJMP personnel may use these materials solely for official duties. Unauthorized reproduction, modification, or distribution of any content is strictly prohibited.

6. Limitation of Liability
Operational Risks: BJMP personnel use the platform at their own risk. PCES Inc. is not liable for any direct, indirect, incidental, or consequential damages resulting from the use of the platform, including any errors or omissions in the content or data.
Legal Compliance: BJMP and its personnel are solely responsible for ensuring that their use of the platform complies with all applicable laws and regulations. PCES Inc. is not liable for any legal issues arising from non-compliance.

7. Indemnification
Responsibility: BJMP personnel agree to indemnify and hold harmless PCES Inc. and its affiliates from any claims, damages, or liabilities arising from the misuse of the platform, violation of these Terms, or any breach of applicable laws or regulations.

8. Termination and Suspension
Access Control: PCES Inc. reserves the right to suspend or terminate the access of any BJMP user who violates these Terms or engages in activities that threaten the platform’s security, integrity, or functionality.
BJMP Authority: BJMP also reserves the right to revoke platform access for any user who fails to adhere to internal policies or who is no longer authorized to use the platform.

9. Modification of Terms
Updates and Changes: These Terms may be updated or modified by PCES Inc. at any time to reflect changes in legal requirements, BJMP policies, or platform functionalities. All BJMP users will be notified of significant changes, and continued use of the platform constitutes acceptance of the revised Terms.

10. Governing Law and Jurisdiction
Legal Framework: These Terms are governed by the laws of the Republic of the Philippines and must be interpreted in accordance with these laws. Any disputes arising from or related to these Terms will be resolved under the exclusive jurisdiction of the courts of the Republic of the Philippines.

11. Entire Agreement
Full Agreement: These Terms, together with any additional agreements or policies applicable to BJMP’s use of the platform, constitute the entire agreement between BJMP and PCES Inc. regarding the use of the platform and supersede any prior agreements or understandings.

This may include your desired position, employment type, work schedule, preferred job location, expected salary, username, first and last names, password (secure and not visible), age, mobile phone number, gender, address, availability, driver’s license status, highest educational attainment, field of study, school name, years attended, work experience (including job title, company name, employment dates, and company contact number), and any other skills you may possess.

Character Reference Information: If you provide character references, we will collect their names, affiliations, contact information, and other relevant details. This information is used as part of your application process, and prospective employers may contact these references to verify your qualifications. By providing this information, you confirm that you have obtained the necessary consent from your character references to share their data with us.

b) Entity/Employer Information: Entities and employers utilizing our platform for recruitment purposes are required to provide specific information, including but not limited to the entity or employer name, business affiliation, contact information, name of the authorized representative, company description, principal place of business, industry type, and other relevant information necessary for job postings and recruitment activities.

c) Non-Personal Information: We may collect non-personal information about your interactions with our platform, including your IP address, browser type, device information, operating system, and browsing activities. These data help us analyze trends, improve our services, and enhance your experience.

2. How We Use Your Information
We process your personal information for the following purposes:

a) Job Matching: We use your personal information to match you with job opportunities that align with your work experience, educational background, and personal preferences. For employers, we use your information to create and manage job postings and facilitate communication with applicants.

b) Application Processing: Your personal information is shared with potential employers or rehabilitation program coordinators to facilitate the application or assessment process and to enable them to assess your suitability for the role or program.

c) Communication: We may use your contact information to communicate with you about job opportunities, application status, or other relevant updates.

d) Notifications: You may receive notifications related to job matches, application status, or other important updates based on your preferences.

e) Account Management: Your personal information is used to manage your account, including verification, password resets, and account recovery.

f) Service Improvement: We analyze usage data from your interactions with our platform to enhance our services and provide better job matches and relevant content.

g) Legal and Compliance: Your personal information may be used to comply with legal obligations, resolve disputes, enforce our terms of service, and protect the rights, safety, and integrity of our users and services.
